Participant Waiver for Race Registration

Participant Consent, Release and Waiver of Liability • Read Carefully Before Signing

In consideration for my voluntary participation in the Florida Museum Froggy 5K race (the “Froggy 5K”) offered by the Florida Museum of Natural History at the University of Florida, located at 3215 Hull Rd, Gainesville, FL 32611, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Florida Museum of Natural History, the University of Florida Natural Area Teaching Lab, the University of Florida, the University of Florida Board of Trustees, the State of Florida, the Florida Board of Governors, all event sponsors, and their respective employees, agents, representatives, officers, trustees, members, volunteers and successors, (“RELEASEES”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES or otherwise, while participating in the Froggy 5K or while in, on or upon the premises where the Froggy 5K is being conducted. I grant permission to all Releasees to capture and use photographs, video recordings, and any other images or records of the Froggy 5K, in which I am depicted, for any legitimate purpose, without further approval or compensation of any type.

Identification of Risk

I hereby acknowledge the following: (1) the Froggy 5K is a running race that involves and poses risk, inherent or otherwise, that cannot be entirely eliminated that may jeopardize my safety, health, and well-being; (2) I am aware that the Froggy 5K involves physical exertion; (3) I understand that the dangers and risks of participation in the Froggy 5K may include minor to serious injuries before, during, and after participation in the Froggy 5K, including but not limited to physical, mental, or emotional injury or disability, or illness; and (4) I am aware that participating in the Froggy 5K will involve risks for injuries which may include, but are not limited to, serious physical harm, serious neck and spinal injuries, serious injury to bones, muscles, joints, and other aspects of the muscular skeletal system, serious injury or impairment to other aspects of my body, and death.

Acknowledgement of Risk

I am fully aware of the risks and potential hazards connected with participating in the Froggy 5K, and I hereby elect to voluntarily participate in the Froggy 5K and engage in such knowing that such participation may be hazardous to my person. I acknowledge and agree that participation in the Froggy 5K involves exercise and I should consult with my medical professional before participating in the Froggy 5K. I attest that I am medically and physically fit to participate, am in good health, and am properly trained. Additionally, I agree that I have read the rules of the Froggy 5K and agree to follow them. I assume all risks associated with my participation in this event, including, but not limited to, falls, contact with other participants, the effects of the weather, including high or low temperatures and/or humidity, traffic and the conditions of the road, all such risks being known and appreciated by me. I understand that bicycles, skateboards, roller skates or roller blades, animals and personal music players are not allowed during the Froggy 5K and I will abide by all race rules. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, that may be sustained by me, as a result of my participation in the Froggy 5K, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise.

Waiver of Liability

I AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage or costs, including court costs and attorneys’ fees, that I may incur due to my participation in the Froggy 5K, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise. It is my express intent that this Participant Consent, Release and Waiver of Liability shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASEES. I hereby further agree that this Participant Consent, Release and Waiver of Liability shall be construed in accordance with the laws of the State of Florida. IN SIGNING THIS PARTICIPANT CONSENT, RELEASE AND WAIVER OF LIABILITY, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducement, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent, and I execute this Participant Consent, Release and Waiver of Liability for full, adequate and complete consideration, fully intending to be bound by same.
